Welcome to Sweet Cherry ("the App"), developed by Candy Studio Apps ("we", "us", "our"). These Terms of Use ("Terms") apply to the Sweet Cherry app for Solana Mobile, distributed through the Solana dApp Store. By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App. For questions, contact choizzyio@gmail.com. 1. ELIGIBILITY Sweet Cherry contains mature themes. By downloading, accessing, or using the App you represent and warrant that: - you have the legal capacity to enter into a binding contract in your country of residence; - you have reached the age of majority in your jurisdiction; - you are legally permitted to view mature and suggestive content where you live; and - you are not located in, or a resident of, a country subject to comprehensive sanctions, and you are not listed on any applicable sanctions list. We ask you to confirm this at first launch and may request further confirmation at any time. We will suspend or terminate, without notice or refund, any account we reasonably believe does not meet these requirements. 2. DESCRIPTION OF THE SERVICE Sweet Cherry is an AI entertainment app that lets you: - chat and roleplay with AI characters (fictional, AI-generated personas); - create and customise your own AI companions; - generate AI images and videos from text prompts and inputs; - receive AI-generated voice messages; - connect a Solana wallet to buy in-app credits. All characters are fictional and AI-generated. They are not real people, do not represent real individuals, and any resemblance to real persons is unintentional. Conversations and generated media are produced by artificial intelligence and may be inaccurate, fictional, or unexpected. The App is for entertainment purposes only. It does not provide professional advice of any kind (medical, legal, financial, psychological, or otherwise), it is not a mental-health service, and it is not a substitute for professional support or human relationships. If you are in distress or crisis, please contact a qualified professional or your local emergency services. 3. AI-GENERATED CONTENT Content produced in the App is AI-generated. You understand that AI outputs can be imperfect or unpredictable. We apply automated moderation and provide an in-app reporting and flagging tool so you can report content that is offensive, unlawful, or violates these Terms, without leaving the App. Reports are reviewed and acted upon. We may review, filter, or remove content to comply with our policies and store requirements. 4. ACCEPTABLE USE You agree not to use the App to create, request, upload, or share content that: - Involves minors in any sexual or exploitative manner. We operate a zero-tolerance policy; CSAM is strictly prohibited, blocked, and reported to the relevant authorities, and the account is permanently terminated; - Depicts or impersonates a real, identifiable person without their consent, including deepfakes of real individuals; - Is illegal, harmful, harassing, hateful, defamatory, or promotes violence or self-harm; - Infringes the intellectual property or privacy rights of others; - Attempts to bypass safety filters, reverse engineer, scrape, automate, or disrupt the App or its providers; - Resells, redistributes, or commercially exploits generated content in violation of these Terms or applicable law. You also agree not to use the App or its payment flow to launder money, to finance illegal activity, or to evade sanctions or any applicable financial regulation. We may suspend or terminate your access for violations without notice. 5. USER CONTENT AND LICENSE You retain ownership of the prompts and inputs you provide. By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, and display your inputs and generated content as needed to operate, moderate, secure, and improve the Service. This license ends when you delete the content or your account, except where retention is required by law or for safety records. You are responsible for your inputs and for how you use generated content. You must have all rights necessary to any photo or material you upload. 6. WALLET CONNECTION, CREDITS AND ON-CHAIN PAYMENTS The App offers virtual credits ("Gems") that unlock premium features such as extended chatting and image/video generation. Credits are bought on-chain from a Solana wallet you connect yourself, using the Solana Mobile Wallet Adapter. - You are solely responsible for your wallet, your seed phrase and your private keys. We never ask for them, never receive them, and cannot recover them if they are lost. We do not hold or custody your funds. - Prices and what each purchase includes are shown in the App before you confirm. Amounts may be quoted in USD and charged in SOL or USDC at the rate displayed at the time of purchase. - You also pay Solana network fees. Those fees go to the network, not to us. - Blockchain transactions are final and irreversible. Once a transaction is confirmed we cannot reverse it, and we cannot recover funds sent to a wrong address, on an unsupported network, or in an unsupported token. - Credits are delivered once the transaction is confirmed on-chain. Confirmation can be delayed by network congestion. If a confirmed payment is not credited, email choizzyio@gmail.com with the transaction signature and we will resolve it. - Virtual credits have no monetary value. They are not a currency, security, or investment, are non-transferable, cannot be exchanged back into crypto or fiat, and are non-refundable except where required by law. Unused credits expire on account deletion. - Where the App offers a recurring plan, it continues only while you authorise a new on-chain payment. There is no store-managed automatic renewal, so there is no store subscription to cancel — simply stop authorising payments. - EU/EEA and UK consumers have a statutory 14-day right of withdrawal for digital content, which is lost once delivery begins with your express consent. - We may change prices at any time. A change never applies to a purchase you have already made. 7. INTELLECTUAL PROPERTY The App, its software, design, branding, and content (excluding your inputs) are owned by Candy Studio Apps and protected by law. You may not copy, modify, distribute, or create derivative works without our permission. 8. DISCLAIMERS The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI outputs will be accurate, appropriate, or error-free, or that the Service will be uninterrupted or secure. You use the App at your own risk. We do not control the Solana network, your wallet application, or any RPC or infrastructure provider, and we do not guarantee that the network will be available, timely, or free of congestion or fees. 9. LIMITATION OF LIABILITY To the maximum extent permitted by law, Candy Studio Apps shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss of data, profits, funds or goodwill arising from your use of the App, from reliance on AI-generated content, or from any on-chain transaction, wallet failure, or network event outside our control. Where a paid feature is proven not to work as described, our sole responsibility and your exclusive remedy is a refund of the amount you actually paid for that feature; we are not liable for any other or further damages. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or your mandatory statutory consumer rights. 10. INDEMNIFICATION To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless Candy Studio Apps and its owners, employees, partners and service providers from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or related to any content you upload, create, generate or share, your use or misuse of the App, or your violation of these Terms, any law, or any third-party right. 11. TERMINATION We may suspend or terminate your access at any time for violation of these Terms. You may stop using the App and delete your account at any time — in the App via Profile → Settings → Delete Account, or by emailing choizzyio@gmail.com. Deleting your account deletes your data as described in our Privacy Policy. It does not and cannot remove transactions already recorded on the Solana blockchain. 12. GOVERNING LAW These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the competent courts of Poland, unless mandatory consumer-protection laws of your country of residence provide otherwise. 13. SEVERABILITY & ENTIRE AGREEMENT If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Candy Studio Apps regarding the App and supersede any prior agreements. 14. CHANGES TO THESE TERMS We may update these Terms from time to time. The latest version will always be available within the App and at meetevia.com/cherry/terms.
