Welcome to Evia ("the App"), developed by Sweet Studio ("we", "us", "our"). By downloading, accessing, or using the App, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the App. For questions, contact choizzyio@gmail.com. 1. ELIGIBILITY The App is not intended for users under 14 years old. By using the App you represent that you are at least 14 years old (or the minimum age of digital consent in your country), and that you meet the age of majority in your jurisdiction before accessing any mature content. We may terminate accounts that violate this requirement. 2. DESCRIPTION OF THE SERVICE Evia is an AI entertainment app that lets you: - Chat with AI characters (fictional, AI-generated personas), and - Generate AI images and videos from text prompts and inputs. All characters are fictional and AI-generated. They are not real people, do not represent real individuals, and any resemblance to real persons is unintentional. Conversations and generated media are produced by artificial intelligence and may be inaccurate, fictional, or unexpected. The App is for entertainment purposes only and does not provide professional advice (medical, legal, financial, psychological, or otherwise). 3. AI-GENERATED CONTENT Content produced in the App is AI-generated. You understand that AI outputs can be imperfect or unpredictable. We apply moderation and provide an in-app reporting/flagging tool so you can report content that is offensive or violates these Terms. We may review, filter, or remove content to comply with our policies and app-store requirements. 4. ACCEPTABLE USE You agree not to use the App to create, request, upload, or share content that: - Involves minors in any sexual or exploitative manner (zero tolerance — CSAM is strictly prohibited and reported to authorities); - Depicts or impersonates a real, identifiable person without their consent (including deepfakes of real individuals); - Is illegal, harmful, harassing, hateful, defamatory, or promotes violence or self-harm; - Infringes intellectual property or privacy rights of others; - Attempts to bypass safety filters, reverse engineer, scrape, or disrupt the App or its providers. We may suspend or terminate your access for violations without notice. 5. USER CONTENT AND LICENSE You retain ownership of the prompts and inputs you provide. By using the App, you grant us a limited, non-exclusive license to process your inputs and generated content as needed to operate, moderate, and improve the Service. You are responsible for your inputs and for how you use generated content. 6. SUBSCRIPTIONS, CREDITS, AND PAYMENTS The App offers virtual credits and auto-renewing subscriptions for premium features (e.g., chatting, image/video generation). - Prices are shown in the App before purchase. Payments and renewals are processed by the app store (Google Play / Apple), subject to their terms. - Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your app-store account settings. - Virtual credits have no monetary value, are non-transferable, and are non-refundable except where required by law or app-store policy. Refunds are handled per the app store's refund policy. 7. INTELLECTUAL PROPERTY The App, its software, design, branding, and content (excluding your inputs) are owned by Sweet Studio and protected by law. You may not copy, modify, distribute, or create derivative works without our permission. 8. DISCLAIMERS The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI outputs will be accurate, appropriate, or error-free, or that the Service will be uninterrupted or secure. You use the App at your own risk. 9. LIMITATION OF LIABILITY To the maximum extent permitted by law, Sweet Studio shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss of data, profits or goodwill arising from your use of the App or reliance on AI-generated content. Where a paid feature is proven not to work as described, our sole responsibility and your exclusive remedy is a refund of the amount you actually paid for that feature; we are not liable for any other or further damages. 10. INDEMNIFICATION To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless Sweet Studio and its owners, employees, partners and service providers from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or related to any content you upload, create, generate or share, your use or misuse of the App, or your violation of these Terms, any law, or any third-party right. 11. TERMINATION We may suspend or terminate your access at any time for violation of these Terms. You may stop using the App and delete your account at any time (in-app or via choizzyio@gmail.com). 12. GOVERNING LAW These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the competent courts of Poland, unless mandatory consumer-protection laws of your country of residence provide otherwise. 13. SEVERABILITY & ENTIRE AGREEMENT If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sweet Studio regarding the App and supersede any prior agreements. 14. CHANGES TO THESE TERMS We may update these Terms from time to time. The latest version will always be available within the App. Continued use after changes constitutes acceptance. 15.
